Understanding Michigan's Laws on Transporting or Possessing a Firearm in a Motor Vehicle
We are examining an excerpt from the Michigan Penal Code, Act 328 of 1931, Section 227d. This law stipulates the conditions and restrictions for transporting or possessing a firearm or certain types of pneumatic guns in or upon a motor vehicle or self-propelled vehicle designed for land travel.
Transporting or Possessing Firearms or Pneumatic Guns in Vehicles
According to this law in Michigan, unless permitted otherwise, an individual should not transport or possess in a motor vehicle or any self-propelled vehicle designed for land travel:
-
A firearm (other than a pistol) unless it's unloaded and meets one or more of the following conditions:
- It is disassembled (taken down).
- It is enclosed in a case.
- It is stored in the trunk of the vehicle.
- It is placed in a location inaccessible from the interior of the vehicle.
-
A pneumatic gun that expels a metallic BB or a metallic pellet greater than .177 caliber, unless the gun is unloaded and it meets one or more of the same conditions as the firearm.
This law applies only to firearms other than pistols, and to pneumatic guns that expel a metallic BB or pellet larger than .177 caliber. It doesn't cover pistols or smaller caliber pneumatic guns.
Penalties for Violations
A person who violates this law is guilty of a misdemeanor, punishable by:
- Imprisonment for not more than 90 days,
- A fine of not more than $100,
- Or both imprisonment and a fine.
Firearm and pneumatic gun owners must be aware of these regulations to avoid unintentional violations. However, as laws may change over time and specific circumstances can vary, always consult a legal professional for advice related to your particular situation.
