Understanding Michigan's Laws on Transporting or Possessing a Loaded Firearm in a Vehicle
Here we are examining an excerpt from the Michigan Penal Code, Act 328 of 1931, Section 227c. This section discusses the legal repercussions for transporting or possessing a loaded firearm or a specific kind of pneumatic gun in or on a vehicle.
Transportation or Possession of Loaded Firearms or Pneumatic Guns in Vehicles
Under Michigan law, unless otherwise permitted, a person is not allowed to transport or possess any of the following in or upon a vehicle (including a sailboat, motor vehicle, aircraft, motorboat, or any other vehicle propelled by mechanical means):
- A loaded firearm, other than a pistol.
- A loaded pneumatic gun that expels a metallic BB or metallic pellet greater than .177 caliber.
It's worth noting that the law distinguishes between types of firearms. In this case, only the transportation or possession of loaded pistols is exempted from the rule.
Penalties for Violation
Violating this section of the law is considered a misdemeanor in Michigan. The penalties include:
- Imprisonment for no more than 2 years,
- A fine of no more than $2,500,
- Or both imprisonment and fine.
Remember, it's important to be aware of these laws to avoid unintentional violations, especially if you're a firearm or pneumatic gun owner. However, laws may change, and individual situations can vary, so always consult with a legal professional to get advice tailored to your specific circumstances.
