Act 328 of 1931
Section 265a: Union Label Counterfeiting, Imitation, Unauthorized Use
Section 265a of the Michigan Penal Code addresses the offense of counterfeiting, imitating, or unauthorized use of a union label. The purpose of this law is to protect the rights and interests of labor organizations or associations of working-men by prohibiting the unauthorized use of their union labels.
According to this statute:
- It is a misdemeanor offense for any person to counterfeit or imitate a union label. This prohibition applies to the unauthorized replication or imitation of a union label that belongs to a specific labor organization or association of working-men. A union label, as defined in this section, refers to a trademark, term, design, symbol, or device adopted by a labor organization or association of working-men to distinguish their craft, trade, or work, or to indicate membership in or work performed by such organization or association.
- It is also a misdemeanor offense for any person to use a union label without the authority of the particular labor organization or association of working-men to which the union label belongs. Unauthorized use of a union label undermines the purpose and integrity of the label as a distinguishing mark associated with the specific labor organization or association.
History: Section 265a was added to the Michigan Penal Code through Act 62 of 1957, which became effective on September 27, 1957.
